00:00:00:00 - 00:00:28:23 Unknown They just keep pushing for more and more and more. Yeah, well, this one isn't anything special, I. I won't go into it, but it's not thing difficult to prove before you make a big deal. We are not there to change anything. Oh, they're not? No, it's just making the vinyl sign digital, which I'll show you. So I don't think that's going to be a huge list like the other ones, too. 00:00:28:25 - 00:00:56:15 Unknown Well, that gentleman, just like with everything else, the the last ones, the same commitments about the city schools putting stuff on. Is there. So you can you can add to those if you want it to. So it's similar to the ones you approve of. Yeah. Yeah. Oh, that's earth shattering. Well, I noticed that one gentleman last night said to me, he said this and I said, So we haven't got interesting. 00:00:56:17 - 00:01:19:26 Unknown Well, I think so. We weren't here. We just do a bit of every chat about it. Okay. Well, we missed you. The gentleman that came was very nice, but we missed you. No, man, I get it. All right, let's get started. Welcome to the Board of Zoning Appeals. The mike's not going to get any better, John. I apologize for replacing them. 00:01:19:28 - 00:01:42:26 Unknown This is the best I can do. Any person that desires to speak can provide testimony during today's hearing was first complete The sign in slip located on the back of the table in the back of the room. 00:02:02:12 - 00:02:24:14 Unknown The slip must be presented to the counsel and board before your before you provide your testimony. Staff will then present the administrators comments regarding the petition. At the beginning of the hearing. The board may impose various conditions as amendments before reaching a decision on certain petitions, the installation of landscaping and screenings, the paving of park areas and the dedication of right away are examples of such conditions. 00:03:20:20 - 00:03:40:22 Unknown These conditions are an integral part of the board's decision and must be met for granted. Variance to be valid. Every decision of the Beach Grove Board of Zoning Appeals shall be subject to judicial review. If anyone plans to speak today, could you please stand and raise your right hand? Do you swear to tell the truth, the whole truth, and nothing but the truth? So if you God, thank you. At this time we'll call the petitioner of your 15 minutes. And if you just want to hit the button on that, Mike picks you up. 00:04:04:24 - 00:05:00:04 Unknown That would be great. We did it. Thank you. Three each basic Thank you very inspirational talk. Yep. Little turn right. There we go. Well, hi, everyone. My name's Alan Townsend. I work at 111 monument Circle, Suite 2700, Indianapolis. I represent OUTFRONT Media, one of the largest and most respected outdoor advertising companies in the country. In your handout, I provided you on your tab one a little bit of information about out front. 00:05:00:07 - 00:05:27:03 Unknown To the extent you would like to do some light reading things, I don't get to pick. I also have with me today my client, Representative Shelly Bergeron, from out front. I've worked with Shelly for probably 20 years plus now. She's been with out front for a long time. This application seeks the conversion of an already existing off premises outdoor advertising sign to a digital outdoor advertising sign. 00:05:27:06 - 00:05:57:20 Unknown The signs are approximately 36 feet in height. It's a 14 by 48 in size, with back to back faces that contains a mix of advertisements for national and local businesses is located. It has an address of five, five, five, five Elmwood Avenue. It's actually oriented to Interstate 65. If you look at tab two of your binder, you can actually see a aerial photo of the sign. 00:05:57:22 - 00:06:23:17 Unknown I always think these things are better if I provide some visual aid. So if you see where the Green Arrow is under tab two, it's kind of hard to see the sign. But that points right at the strange sign structure, which is oriented, where 65 if you look at tab three, it's a similar photo of the same thing, but it shows the boundaries of the properties in that area and the signs are actually on that parcel. 00:06:23:17 - 00:06:54:10 Unknown They're in the middle of Elmwood Industrial LLC. Then in tab four you can actually see a ground level view of one side of the sign that would be the east face. So if you're driving west on 465, that's what you would see from the roadway. This is kind of a commercial industrial area. It's zoned i3 and it's surrounded by other commercial and industrial type uses. 00:06:54:12 - 00:07:26:03 Unknown There's an area that's appropriate for signs and digital signs. This would be the property where the sign is located is on property owned by Elmwood Industrial and given you under tab five a copy of the deed by which states entitled to see. You can see who the owner is. Your tab six In order for us to come before you, when we're seeking a variance of some type on property that someone else owns, which that's what's happening here out front, seeking the variance. 00:07:26:05 - 00:07:53:01 Unknown But it's on property that Elmwood Industrial owns. We have to get a consent form from the landowner and that's what you see under tab six was the consent form from Mr. Currie at Elmwood under Tab seven, I provided you with a letter of support from the owner of the property. He knows exactly what we're doing here today and is supportive of it and would like to see the variance presented. 00:07:53:03 - 00:08:15:00 Unknown So we're clear on what we're asking for. This existing structure would remain exactly where it is was already in pole in the ground. The pole would be moved, nothing would come forward or backward. All we would be doing was be replacing what's up on the head of the sign, replacing kind of the cages that are up there that hold that advertising material. 00:08:15:00 - 00:08:45:21 Unknown Now with digital screens on both sides, giving you kind of a detailed description in your booklet under tab eight, everything we're doing out there and will change the height of the sign won't change the size of the faces. The faces would remain in place for 8 seconds before it instantly changes to a new face and the sign will still be oriented to 465. 00:08:45:24 - 00:09:10:25 Unknown The digital face actually have a really good technology. There's a light sensing technology that makes them dimmer as it turns to evening. And then tonight. So it's not the same level of brightness every day. It even has these cybersecurity controls built into it. So somebody tries to hack the sign and put up a different message. It'll go black in the event there's some catastrophe, there's a power outage. 00:09:10:25 - 00:09:39:07 Unknown You know, sometimes your TV will go on the fritz. This will turn black in case of some catastrophic power outage or so why why would out front light to use a digital? Certainly there are lots of reasons, but the highlights are what I've given you under tab nine. Just all sorts of things you can do with a digital that you can't do with the traditional technology. 00:09:39:09 - 00:10:06:21 Unknown The messages can get out faster. It's better for the advertiser advertisers because it's easier for them to control their message. Right now, as I think I mentioned, when you want to change an ad on a sign, the advertiser has to order a big piece of vinyl and somebody literally has to climb up there, take down the old one and put up the new one, and they'd strap it on the straps around the back so it's tight and doesn't come loose during the win. 00:10:06:23 - 00:10:32:05 Unknown So it's actually safer because no workers have to climb up there anymore and the production costs are limited because the ad can be changed with a with a computer. The digital also allows more accessible leave for local businesses and nonprofits. When you use those big pieces of vinyl, typically, at a minimum, they go up for a month because there is a lot involved in getting one up. 00:10:32:05 - 00:10:59:28 Unknown If you use a digital ad, sometimes advertisers can put something up over a weekend or around a special event, a matter of days that you really just can't make work with. The with the vinyl faces. These digital faces will also be part of the National Amber Alert Network. I've actually given you under Tab ten all the different ways some of our governmental organizations make use of digital signs. 00:11:00:00 - 00:11:28:23 Unknown There's the National Highway Traffic Safety Administration that uses them. Sometimes the FBI uses them for the most wanted. There's an Amber Alert and even FEMA, sometimes in the event of an emergency, will use digital signage, like I said. And of course, also can be used for community organizations and even Beach Grove. We'd like the opportunity to sit down and talk to the city about how we could make it work for them. 00:11:28:25 - 00:11:59:22 Unknown So I'm familiar with the standards oh three under Title seven, I've given you just a little data on all the Amber Alerts that go up, can go up on digital signs and just the vast number. And I'll tell you, the Amber Alerts work, but the key for Amber Alerts to work is they have to message has to go out quickly, instantaneously, which you really can't make do with that traditional vinyl map. 00:11:59:24 - 00:12:22:25 Unknown So like I said, I'm familiar with the standards we have to satisfy to earn your support and earn a variance for you. The first one is that it won't be damaging to health, safety, public welfare or the morals of the community. Just I can tell on my research the structure that's actually been up there has been up there for 41 years and actually predates the current owner. 00:12:22:27 - 00:12:46:02 Unknown We don't have any evidence to prove any kind of complaint. I'm concerned about the site in any way. The only difference with this sign will be the manner in which the ad is displayed. So right now, at night, the sign is lit up with external lighting. If we're allowed to install the digital, really, the lighting will be internal, not external. 00:12:46:05 - 00:13:10:25 Unknown So, you know, the Indiana Department of Transportation allows digital signs, but I've given you under tab 12 is a summary of the rules that the sign companies have to comply with. If we get a digital or changeable message permit print and DOT and we will comply with all the rules we actually already have the permit. The sign sign business can be kind of unusual. 00:13:10:25 - 00:13:31:12 Unknown So to do a sign like this in this location, we have to get a permit from DOT and then we have to come in and get a variance or a special exemption for you. So it's actually a two step process and we can't convert to the changeable message or digital sign unless everybody says, okay, the 8 seconds for the changeable message that actually comes out of end. 00:13:31:12 - 00:13:54:06 Unknown Dot's advertising manual right there down toward the bottom of the page, as mentioned, that that's where we got the 8 seconds. So we try to comply with that. We do comply with all the rules wherever we can have the digital. I think when you hear the remonstrance from the city, their primary concern will be, well, we are concerned that this will distract drivers. 00:13:54:09 - 00:14:23:05 Unknown We can tell you I've research, researched and research trying to find data or information about whether digital signs distract drivers in a manner that results in an accident. And I can't find any evidence that supports that claim. But I've given you under Tab 13 is a summary of some information that the they gathered trying to find that there's a causal connection between digital signs and driver distraction or accidents. 00:14:23:11 - 00:14:54:09 Unknown And the conclusion is, well, there's not a link. It would be within your right to say, well, hey Alan, what's the oh, triple A? It's a, it's an association. And for advertising companies so you might say that's suspect but I gave you under tab 14 is an actual study that I found from the Federal Highway Administration, the U.S. Department of Highway Administration, that study back in 2012, which is the most current one I can find, came to the same conclusion. 00:14:54:14 - 00:15:20:20 Unknown They don't find a causal connection between accidents and digital signs. There are at least, I think, seven digital signs in Marion County already. I know there's two on I-70. One is you head to the airport, one out on the east side of town. There's two right up when you go past the state fairgrounds on Fall Creek, there's one in Castleton, there's two in Lawrence. 00:15:20:20 - 00:16:02:24 Unknown Halprin has one in Lawrence that we were able to build with the permission of the Lawrence BCA a couple of years ago. There's at least 41 in adjacent counties around Indianapolis and I don't have any data showing causal connection between digital and distracted driving. Believe you. Believe me, I would if there was a problem or a link between the two, but I've given you under tab 15 are our structural drawings for the sign that may be more minutia than you want, but these structures actually have to be engineered to withstand the weight and width of high speed winds. 00:16:02:27 - 00:16:34:00 Unknown And they are. So this pole will remain as is that the structure that's been there is engineered to support a visual. The second part we have to prove is that we're not going to affect neighboring landowners in a substantially adverse manner. You you know, there's no evidence this sign that's been there for 41 years. We do that. All we're really doing is upgrading the sign for the current technology, which wasn't available when it was built. 00:16:34:03 - 00:17:03:26 Unknown And it will be safer with no workers having to climb the frame to change the. And the third part, we have to approve is that the need for the variance arises for some condition peculiar to the property. The condition peculiar to the property is Indianapolis has a sign ordinance that says you can't have digital at all. Now this it's kind of unusual because you're Beech Grove, but you actually operate under the Indianapolis Sign ordinance. 00:17:03:28 - 00:17:31:09 Unknown So the other communities we've gone to that are part of the five excluded cities speedways have been receptive to digital warrants. We hope you are too, but you get to decide whether digital is authorized or appropriate for your community in this location. All the properties around this east and west, even north, are industrial and commercial, so won't take anything out of order. 00:17:31:12 - 00:18:06:19 Unknown Knock somebody off their game to have a digital there. It does seem, has always seemed to me a little counterintuitive to tell businesses along that corridor that you can upgrade for technology better when it gets to outdoor advertising science. The city of Indianapolis tells them now. So we think we satisfy both third and fourth prong because it's an unnecessary hardship that we're not allowed to upgrade like other businesses, especially for a technology that's proven and works, it works in other communities around Indianapolis. 00:18:06:21 - 00:18:35:01 Unknown Alfred has digital signs and whites Town, Lebanon, Greenwood, and they've all been successful there. Finally, the grant. The last thing we have to prove is that Grant doesn't unnecessarily interfere with the comp plan. This comp plan, at least for Indianapolis in this area, calls for commercial industrial businesses and we think that's what we do. We help promote national and local businesses with advertising opportunities that they think is right for them. 00:18:35:03 - 00:19:00:12 Unknown Outdoor advertising isn't for everybody, but it's for a lot of people. It's effective and customers like to use it. And advertisers like the flexibility it provides that the traditional signs can. Any questions I can answer or Shelly answer, She knows her business better than I do. We'd be happy to field them, but we very much appreciate your support. 00:19:00:15 - 00:19:20:09 Unknown Shelly and I did come down and meet with the mayor about a year ago to let him know this is what we're thinking, This is what we'd like to do. He certainly seemed supportive in our meeting and said, go ahead and and do the process. So it took us a while to get all the ducks lined up. Here we are. 00:19:20:09 - 00:19:47:26 Unknown So thanks for your support. Thank you. To support. Have any questions you should. How many seconds for each one of these advertising? 8 seconds. Is that what, 8 seconds? So the ad itself, there's not movable parts on the ad. It's not like the cartoon on a TV show. So the ad is is fixed. You see an ad and then at 8 seconds, the ad flips instantly. 00:19:47:29 - 00:20:14:25 Unknown And there's a there's a new ad number. So that's just like the ones we've approved before. Okay. Absence. That's been 8 seconds before. 8 seconds before. Okay. Thank you. And one of the thing I think I should mention, we have seen the commitments that other sign companies have provided when they've come before you. And we're happy to accommodate and do all those if we earn your support through various special exemption. 00:20:14:28 - 00:20:42:06 Unknown So you will you will allow free advertising from the city schools. Right? We would work with them to provide a flip on the ad based on availability. There may be times during the year where where we're full up from school, but we can always work with them on availability. And whether it's the schools. One thing that's really helpful to have with something like that is a point of contact. 00:20:42:09 - 00:21:04:17 Unknown So if there's somebody at your administering your city administration that can be the gatekeeper for where their requests flow, I'd be really helpful. I think we have somebody that's that. I think so, Yeah. Well, okay, we can define that It would probably for the schools that they have a point of contact and then the government side and we can we could do it over here. 00:21:04:19 - 00:21:28:15 Unknown Okay. I do have one question I'll and I'll get to that point with the previous ones that have been approved with those commitments, the commitment is expanded just a little bit to include help with formatting for for like, you know, forgive my ignorance about how this is, but, but the format, the artwork. Yeah. Because we don't have artwork experts to to be able to address that. 00:21:28:17 - 00:21:57:04 Unknown Can you could you state your name. I'm sorry my name is Shelley the journal and then we're out front Media Yeah, our company provides that. So if I have a point of contact with the school system or your government and you can work with our artist, you know, just to say, you know, we're having this festival or the school is having this event, we can help you come up with that artwork or if you already have someone, maybe your PR person has artwork, we can get it resized to fit our needs. 00:21:57:07 - 00:22:26:15 Unknown Yeah. Thank you. Thank you so, so. And excuse me. And I am assuming that you would do this to help the city with that charge, which are. Thank you. Cover any further questions. Thank you. Okay. Thank you. This time, if there's any response traders, now would be the time. No scene at this time. We'll call staff. All right. 00:22:26:21 - 00:22:49:17 Unknown Good afternoon, everyone. Able to hear me? Okay? I'm good. Thank you. Glad to hear that. All right. My name's Michael Marion County. The staff, I think that most of you were here last month. Of course. Good to be back. And thank you, Mr. Thompson, for that presentation as well. This is a somewhat similar case that on the we heard last month and staff's recommendation of denial is also somewhat similar to those previous arguments. 00:22:49:19 - 00:23:15:20 Unknown This request is different in that it doesn't involve a relocation or a height change, but it would grant permission for digital video screens to be installed onto the existing billboard at 5555 Elmwood District. The bit of info on where that is already, but it's a site around two acres in size. It is industrial in nature and borders, I-4 65 to the south and there's an existing sign there that has two phases to both westbound and eastbound traffic. 00:23:15:22 - 00:23:38:25 Unknown That site was established with its current height and in its current location via a variance petition from this board in 1987. At this variance were denied. It could continue to function legally at that site with the existing final phases in addition to that variance for switching over to the to do digital. But they're also requesting 8 seconds change over four messages instead of 10 seconds as required by Marion County rules. 00:23:39:02 - 00:24:04:27 Unknown That sounds like the state end requirement is a minimum within seconds. Our ordinance specifies that site. So that's why that move that is posted as well. Our ordinance does typically disallow full digital signage on billboards just for having based on the public safety concerns of potentially distracted motorists moving at high rates of speed feels like it could be potentially compounded by a request for 8 seconds between those static messages instead of the required time. 00:24:04:29 - 00:24:23:09 Unknown I'm assuming the second request is based in part a lot of motorists to see, you know, to add to, say, drive by instead of one. That's understandable why they would want that, you know, maximize ad revenue for the amount of messages that can be displayed South is sympathetic to that does not feel that it constitutes a site specific practical difficulty. 00:24:23:12 - 00:24:44:29 Unknown It stands to reason that if distractions were to be caused by these billboards, that quicker message changes would result in higher levels of motorist distraction. And that about one of the auto that's in India are on interstate roads. Geoff is generally pretty wary of added risk factors for these sorts of areas. That's based on 2022 data from the National Highway Traffic Safety Administration. 00:24:44:29 - 00:25:03:06 Unknown In coordination with our Use Public Policy School, the applicant presented some numbers there as well. I think that's definitely helpful context. I've not have a chance to jump in and look at those numbers yet and I look forward to doing so. My guess is that the writers of this ordinance rule were also considering that sort of context when these rules were initially written. 00:25:03:09 - 00:25:37:09 Unknown This exists along a section of interstate with a high saturation of signage and billboards already both on and off premises. Signage are along that stretch of the interstate Sandhills and another digital sign into the mix, Spirited will distract attention away from the road as well as from other legally established signs which might reduce their value somewhat. There are some previously approved signs for previously approved variances for digital signage in this area, already outside bills and the addition of multiple video screens in these areas and close proximity could have a competitive effect and increase overall distraction levels. 00:25:37:09 - 00:26:02:01 Unknown You know, do it for frames versus just one that's a sport is aware and that speaks to some did do over required for the phrase to be utilized for these sorts of variances is the idea of practical difficulty or of hardship. Typically those need to be site specific and to prevent the site or improvements on it from being used in an alternate manner that feels the applicant has failed to identify that sort of hardship for either digital conversion request. 00:26:02:01 - 00:26:20:03 Unknown It seems like the site is able to attract a regular advertiser base already for a recent Google Street photography or for the reduction of time between message swishes. That sounds like a sort of a broad 10,000 foot sense of disagreement with the rule, which is certainly the right of staff does not feel that that constitutes a practical difficulty. 00:26:20:03 - 00:26:48:09 Unknown Though the audience was actually amended somewhat recently. These changes want to do effect in, I think it was mid-January related to a partial compromise on some digital elements being placed on sites, on the full digital screens with the added messages are still disallowed fully, but the flexibility does now exist to place price packs. You know, things like gas station signs and like those digital sort of frame numbers of those can be placed on one side of a billboard face. 00:26:48:11 - 00:27:17:03 Unknown They're allowed to change over three times per day and then they're allowed 10% of the total same face. This proposed sign would exceed that obviously be 100% that would be on both sides and be changing more than three times a day for sure. So given that lack of practical difficulty, the fact that the sign doesn't come close to matching that recent compromise was written into ordinance about some digital elements on signs and steps desired to avoid any potential for artificial distraction of changes to those screens. 00:27:17:09 - 00:27:38:11 Unknown But recommending denial, if you sort of prove this over a recommendation of denial, it would be better to include would be commitments that were discussed but not and suddenly you're right in support. Ask for clarity on the phrasing of those specifically, you know, talking about the artwork and the introduction of city messages, you can feel free to have asking questions about the wording of that as needed. 00:27:38:13 - 00:28:07:19 Unknown There's also only three members here today, so it would require unanimity for any action to be taken if the vote ends up going to one votes and decisive votes, we would just hear this again next month. So any other questions they could answer that should be your questions. Thank you. This time, the petitioner has 5 minutes. If you would like to respond to anything that staff as president. 00:28:07:22 - 00:28:30:08 Unknown Thank you. I've worked with Shelly, like I said, for probably about 20 years, and I told Michael earlier, the next time I go to a variance hearing of the city of Indianapolis, where the city writes a report supporting something, Shelly and I request it will be the first. He got a chuckle out of that, too. So I understand the city's position and I don't agree with it. 00:28:30:11 - 00:28:57:15 Unknown That's fine. When we were studying the application, we looked at the commitments that Reagan agreed to that were recorded back in September of 23. Those were certainly things that were fine with us many, and if we would want to use those as a starting point, now that we've had a little bit of a discussion, you know, it may be a good idea of the one about working with the city, working with the schools. 00:28:57:15 - 00:29:17:12 Unknown We designate points of contact in there. So it's in there about who we're supposed to reach out to for ADD or content or artwork. And these are certainly fine with us, even if they're fine tuned a little bit to make it more clear what the obligations are. But we believe we earned your support and we very much appreciate it. 00:29:17:14 - 00:29:44:02 Unknown Thank you for having us. And those are republished. Just a couple questions. QUESTION Thank you. Two, Those are republished in the staff report, right? Where others are saying, I shared these with the staff and I think he incorporated American Standard. 437 Correct. If I recall. Yes. It's okay. Yeah, those are discussions. Okay. We're on the same council. Yeah. 00:29:44:02 - 00:30:11:00 Unknown So so the only thing I would recommend to the board to, to add to these commitments, if you want to go to a proof is in seven, I would add where it says that the billboards also periodically display noncommercial messages from the city of Beech Grove, and the petitioner will work with the city on the artwork for those messages. 00:30:11:02 - 00:30:39:15 Unknown Manager Should we mention Cultural Corporation? It's already in there. It says that this may include city messages. BGP Yes, which is a description. Okay, I didn't catch the that's okay. And then obviously the police fire and every other public safety. So if you guys were to approve it, I mean, the only change I would recommend making and I would specify well, let me specify first on the record, Mr. Johnson is out front amenable to that change. 00:30:39:20 - 00:31:03:05 Unknown Yes. And all of those seven commitments with that change. Yes. Okay. So then the motion, if you wanted to make it to approve or whatever, but if you want to make able to approve, it will just be with the seven commitments as we stated here. Is it that captures over the week we talked about the board to have any questions. 00:31:03:05 - 00:31:31:06 Unknown Thank you.
